Viral marketing legality

All messages or advertising sent to internauts must mentioned that it is an advertising only when it can make a confusion in the understanding of the costumer. It is important to mentionne that because, generally in an advertising campain using viral marketing, the fisrt message is made to intrigue the costumer. The goal being to favour the word of mouth , it is just at the end of the campaign that the costumers know the brand of the product.

The law of the 11 st march 2003 forced announcers to give some informations . For exemple, that the costumers or the authority could access to informations permiting to indentify the compagny.(denomination, geographical address, company’s number phone).

 More over the using of a personal mail for send on advertising without the agreement  of the person is forbidden. Thus the announcers can’t use mailaddress as they want.To ask the agreement of the person the company proposes to the internauts to file a newsletter that prove their agreements.

The spam

The spam are unsolicited message send by company that don’t have the ageement of customers. this message are made to promote a product or a service. generally when an internaut receive a spam he does’nt receive one message but a lot of messages in the same time.
